97 Verzoekster betoogt dat zij door de bevestiging door het DAFSE in 1998 van de feitelijke en boekhoudkundige juistheid van de gegevens in de aanvraag om betaling van het saldo het recht heeft verkregen op betaling van de bijstand.

Volgens de Commissie had rekwirante na die brief niet moeten volstaan met het instellen van een beroep bij de nationale rechter, maar had zij formeel haar opmerkingen over die brief moeten indienen, zodat die door het DAFSE aan de Commissie konden worden meegedeeld.
According to the Commission, the appellant should not have confined itself to instituting proceedings before the national courts in response to that letter but should have formally presented to DAFSE its observations on the letter for forwarding to the Commission.

Het DAFSE en de Commissie hebben aldus aangenomen dat het voor bijstand in aanmerking te nemen bedrag niet 5 850 000 PTE (130 dagen à 45 000 PTE) maar 5 460 000 PTE (130 dagen x 6 uur x 7 000 PTE) was.
The DAFSE and the Commission thus considered that the eligible sum was not PTE 5 850 000 (130 days at PTE 45 000), but PTE 5 460 000 (130 days x 6 hours x PTE 7 000).

In die brief heeft DAFSE echter niet alle opmerkingen van verzoekster over de door hem beoogde verminderingen overgenomen.
In that letter, DAFSE did not accept all the observations made by the applicant regarding the proposed reductions.

17 Aangezien het eerste voorschot 73 160 730 ESC had bedragen (zie hiervóór, punt 13), wijzigde het DAFSE die aanvraag op 12 februari 1990 in die zin, dat aan de Commissie moest worden terugbetaald een bedrag van 8 637 205 ESC, gelijk aan het verschil tussen het aan verzoekster uitgekeerde voorschot en het gedeelte van de totale kosten van de opleidingsactie ten laste van het ESF, zoals vermeld in verzoeksters gewijzigde aanvraag om betaling van het saldo (zie hiervóór, punt 15) (73 160 730 ESC - 64 523 525 ESC).
17 As the first advance had been of PTE 73 160 730 (see paragraph 13 above), on 12 February 1990 DAFSE corrected that claim stating that it was necessary to repay the sum of PTE 8 637 205 to the Commission, which corresponded to the difference between the advance paid to the applicant and the proportion of the total cost of the training programme to be met by the ESF, as stated in the amended claim for final payment submitted by the applicant (see paragraph 15) (PTE 73 160 730 minus PTE 64 523 525).

16 Bovendien blijkt, dat de betrokken beschikking door de Commissie aan het DAFSE is medegedeeld in de vorm van een brief, waarin hem ter kennis werd gebracht, dat de bijstand van het Fonds krachtens artikel 6, lid 1, van de verordening werd teruggebracht tot een lager bedrag dan aanvankelijk was goedgekeurd.
