2 The request has been made in proceedings between SC Fatorie SRL (‘Fatorie’) and the Direcţia Generală a Finanţelor Publice Bihor (the Directorate-General of Public Finance, Bihor) (‘the Direcţia’) regarding the refusal to grant Fatorie the right to deduct VAT on account of a failure to apply provisions relating to the reverse charge system.

The mistake of including the locality of Valea lui Mihai in the county of Satu Mare, in the area of the indication, is a result of the fact that in the past, according to the division/demarcation of wine-growing areas during the period of the Communist regime in Romania, when localities were organised by vineyards and wine-growing centres, there was a well-known vineyard called Valea lui Mihai which extended into the two counties, Satu Mare and Bihor.

Overeenkomstig besluit nr. 397/2003 van de minister van Landbouw, Voeding en Bosbouw tot goedkeuring van de aanwijzing van wijnbouwgebieden en van de groepering van plaatsen in wijnbouwgebieden, wijngaarden en wijnbouwcentra (bekendgemaakt in het Roemeense Staatsblad nr. 513 van 16 juli 2003), punt V — wijnbouwregio Crişanei en Maramureşului, plaats 28, ligt Valea lui Mihai in het district Satu Mare, buiten Bihor, op basis van de oude hierboven vermelde sectoren.
