Makhteshim Agan International Coordination Center en AgrEvo bundelden hun inspanningen in een werkgroep, de zogenoemde „werkgroep endosulfan” (hierna: „werkgroep endosulfan”).
They combined their efforts within a group called the ‘Endosulfan task force’ (‘the task force’).

Bij Verordening (EG) nr. 850/2004, zoals gewijzigd bij Verordening (EU) nr. 519/2012 (10), wordt uitvoering gegeven aan het besluit dat op grond van het Verdrag van Stockholm is genomen om endosulfan op te nemen in deel 1 van bijlage A bij het Verdrag van Stockholm door die chemische stof toe te voegen aan deel A van bijlage I bij Verordening (EG) nr. 850/2004.

Blijkens het procesdossier en het commentaar van het Koninkrijk Spanje ter terechtzitting zijn er evenwel ook andere redenen van bezorgdheid over bijvoorbeeld de mogelijke indringing van endosulfan in bodemwater.
However, it is clear from the documents before the Court and from the comments of the Kingdom of Spain at the hearing that there are also other concerns, regarding, for example, the possibility that endosulfan could enter the groundwater.

Bovendien is de bewering van de Commissie dat de inachtneming van de beperkte GLP de evaluatie voor een groot deel zou hebben ontkracht, niet in tegenspraak met het commentaar van verzoeksters zelf in de brief van 25 juni 2004 waarbij zij een nieuwe GLP aan de beoordelaars hebben voorgelegd, want daarin wijzen zij erop dat de herziene GLP de gevarenanalyse zou vergemakkelijken, in het bijzonder wat de ecotoxicologie en de evaluatie van het traject van endosulfan betreft, hetgeen duidelijk leidt tot ontkrachting van belangrijke aspecten van de evaluatieprocedure en niet alleen nieuwe argumenten met betrekking tot de bestaande evaluatie betreft.
Furthermore, the Commission’s statement that the taking into account of the reduced GAP would have meant that an entire section of the evaluation would have been called into question is consistent with the comments made by the applicants themselves in the letter of 25 June 2004 by which they submitted the new GAP to the evaluators, because they stated in that letter that the revised GAP would facilitate the risk analysis, in particular as regards ecotoxicology and the evaluation of endosulfan’s fate, which clearly implies that significant aspects of the evaluation process would be called into question and does not merely concern new arguments in relation to the existing evaluation.
