1 Bij verzoekschrift, neergelegd ter griffie van het Hof op 7 maart 1990, heeft de Commissie van de Europese Gemeenschappen het Hof krachtens artikel 169 EEG-Verdrag verzocht vast te stellen dat het Verenigd Koninkrijk, door niet de nodige maatregelen te treffen opdat de kwaliteit van het zwemwater in de badzone van Blackpool en in de buurt van Formby en Southport in overeenstemming wordt gebracht met de grenswaarden vastgesteld ingevolge artikel 3 van richtlijn 76/160/EEG van de Raad van 8 december 1975 betreffende de kwaliteit van het zwemwater (PB 1976, L 31, blz. 1; hierna: de "richtlijn"), de krachtens artikel 4 van de richtlijn en de artikelen 5 en 189 EEG-Verdrag op hem rustende verplichtingen niet is nagekomen.
