119 Het is vaste rechtspraak dat de gemeenschapsinstellingen zichzelf voor de uitoefening van hun beoordelingsbevoegdheden gedragsregels kunnen stellen door middel van niet in artikel 189 EG-Verdrag (thans artikel 249 EG) voorziene handelingen, met name mededelingen, voorzover deze mededelingen gedragsregels bevatten inzake de door hen te volgen praktijk en niet derogeren aan de normen van het Verdrag (zie in die zin arresten Gerecht van 17 december 1991, Hercules Chemicals/Commissie, T-7/89, Jurispr. blz. II-1711, punt 53; 5 november 1997, Ducros/Commissie, T-149/95, Jurispr. blz. II-2031, punt 61; en 30 april 1998, Vlaams Gewest/Commissie, T-214/95, Jurispr. blz. II-717, punten 79 en 89).
119 There is certainly settled case-law to the effect that the Community institutions may lay down for themselves guidelines for the exercise of their discretionary powers by way of measures not provided for in Article 189 of the EC Treaty (now Article 249 EC), in particular by communications, provided that they contain directions on the approach to be followed by the Community institutions and do not depart from the Treaty rules (see, to that effect, Case T-7/89 Hercules Chemicals v Commission [1991] ECR II-1711, paragraph 53; Case T-149/95 Ducros v Commission [1997] ECR II-2031, paragraph 61; and Case T-214/95 Vlaams Gewest v Commission [1998] ECR II-717, paragraphs 79 and 89).EurLex-2 EurLex-2
