(109) In een brief van 26 mei 1994 aan vertegenwoordigers van Britannia, Heubach, James Brown, SNCZ en Waardals maakte CEFIC melding van de oprichting van de werkgroep statistiek voor zinkfosfaat in het kader van de brancheorganisaties van CEFIC en verzocht het vóór 15 juni 1994 "historische statistieken over 1991, 1992 en 1993" te verstrekken(52).

Waardals beweert dat pas na een bijeenkomst in 1995 "waar Heubach, [Britannia], en SNCZ toegaven dat zij Teknos hadden verdeeld, leveringen aan Teknos regelmatig ter sprake kwamen op bijeenkomsten waarop Waardals aanwezig was"(43).

Heubach verklaart bovendien dat dit leidt tot zeer frequente, rechtmatige contacten tussen de concurrenten op de markt, waardoor, volgens Heubach, "gemakkelijk de stap wordt gezet naar onrechtmatige contacten"(192).

Daarbij komt dat verzoekster tijdens deze periode in contact is gebleven met de andere betrokken ondernemingen, zoals blijkt uit het feit dat zij op de luchthaven van Heathrow een bijeenkomst met Heubach heeft gehad op 12 juni 1995, te weten op de dag en de plaats waarop een bijeenkomst van de mededingingsregeling heeft plaatsgevonden.
Furthermore, the applicant was in contact with the other undertakings concerned during the period in question, as shown by the fact that it had a meeting with Heubach at Heathrow airport on 12 June 1995, that is to say on the same day and at the same place as a meeting of the cartel.

Zo is zij uitgegaan van de door elk van die ondernemingen in het laatste jaar van de inbreuk in de EER behaalde omzet uit de verkoop van het betrokken product en heeft zij rekening gehouden met het feit dat verzoekster, Britannia (Trident vanaf 15 maart 1997), Heubach en Union Pigments „de belangrijkste producenten van zinkfosfaat in de EER waren, met nagenoeg gelijke marktaandelen van min of meer 20 %” (punten 307 en 308 van de bestreden beschikking).
It thus relied on EEA-wide product turnover in the last year of the infringement achieved by each of those undertakings and took account of the fact that the applicant, Britannia (Trident as from 15 March 1997), Heubach and Union Pigments were ‘the major producers of zinc phosphate in the EEA, with rather similar market shares above or around 20%’ (recitals 307 and 308 to the contested decision).
