38 Tenslotte is de verwijzende rechterlijke instantie van oordeel dat indien het Hof tot de conclusie komt dat, wat zone A betreft, het litigieuze besluit een beheersplan vormt dat nauw verband houdt met of noodzakelijk is voor de bescherming van het gebied van het bergmassief van Imittos, de vraag rijst of het denkbaar is dat dat besluit slechts gedeeltelijk wordt nietig verklaard, en wel voor zover bepaalde gedeelten van dit beschermde gebied – als GCB of SBZ – deel uitmaken van de zones B, D en E in de zin van dat besluit, waarvoor een milieubeoordeling verplicht was, maar niet is uitgevoerd.
38 Lastly, the referring court considers that if the Court of Justice were to conclude that, so far as Zone A is concerned, the contested decree constitutes a management plan that is closely connected with and necessary for the protection of the site of the Mount Hymettus area, the question would arise whether that decree could be annulled only in part, that is, only to the extent that certain parts of the site protected as a SCI or a SPA are included in Zones B, D and E, as referred to in that decree, for which an environmental assessment was required but was not carried out.

36 Volgens de binnen de verwijzende rechterlijke instantie tot uitdrukking gebrachte meerderheidsopvatting, dient deze vraag ontkennend te worden beantwoord omdat het litigieuze besluit, hoewel het strekt tot bescherming van het bergmassief van Imittos en regels bevat die gunstiger zijn voor het milieu, niettemin in alle gebieden bestaande activiteiten en vormen van grondgebruik in stand houdt waarvan de milieugevolgen nooit zijn beoordeeld en bovendien de handhaving toestaat van installaties zoals radio- en televisieantennes, en van scholen, bejaardentehuizen en begraafplaatsen die reeds legaal bestonden.
36 According to the majority opinion expressed within the referring court, that question would fall to be answered in the negative since although the contested decree is intended to protect the Mount Hymettus area and lays down rules more favourable to the environment, it nevertheless preserves, in all the zones [established therein], existing activities and land uses the environmental effects of which have never been assessed and, furthermore, permits existing lawful installations, such as radio-television antennae, schools, retirement homes and cemeteries, to be maintained.

De plannen voor de aanleg van een hoogvoltage-energiecentrale door de PPC zijn goedgekeurd overeenkomstig artikel 24 van de Griekse wet L.2516/1997. De centrale moet komen te liggen in een gebied dat valt onder de B-beschermingszone van de berg Imittos.
The planning and construction of a high voltage power station (HVPS) by the Greek PPC was approved in accordance with Article 24 of the Greek law L. 2516/1997 in an area that belongs to the B protection zone of mount Imittos.

2 Dit verzoek is ingediend in het kader van een door de Dimos Kropias Attikis (gemeente Kropias te Attica) tegen de Ypourgos Perivallontos, Energeias kai Klimatikis Allagis (minister van milieu, energie en klimaatverandering), ingesteld beroep tot nietigverklaring van presidentieel besluit nr. 187/2011 van 14 juni 2011, waarbij maatregelen zijn vastgesteld voor de bescherming van het bergmassief van Imittos en van de hoofdstedelijke parken van Goudi en Ilisia (FEK D’ 187/16.6.2011; hierna: „litigieus besluit”).
2 The request has been made in proceedings between the Dimos Kropias Attikis (municipality of Kropia, Attica) and the Ipourgos Perivallontos, Energias kai Klimatikis Allagis (Minister for the Environment, Energy and Climate Change) for the annulment of presidential decree No 187/2011 of 14 June 2011 on the establishment of protection measures in respect of the Mount Hymettus area and the Goudi and Ilissia metropolitan parks (FEK D’ 187/16.06.2011, ‘the contested decree’).

18 Teneinde de bescherming van het bergmassief van Imittos te verbeteren en de eerdere toepasselijke wetgeving in overeenstemming te brengen met de bepalingen van het BPA, heeft het orgaan voor het bestemmingsplan en het plan voor de bescherming van het milieu in de regio Groot-Athene, ingesteld bij artikel 5 van wet nr. 1515/1985, de procedure voor de wijziging van het presidentieel besluit van 31 augustus 1978 ingeleid.

37 Die opvatting wordt evenwel betwist door sommige leden van de verwijzende rechterlijke instantie, die van oordeel zijn dat het litigieuze besluit een beheersplan vormt dat nauw verband houdt met of noodzakelijk is voor de bescherming van het betrokken gebied, aangezien de indeling van het gebied van het bergmassief van Imittos in zone A een absolute bescherming impliceert, die geen enkele vorm van grondgebruik toestaat, met uitzondering van gebruik dat verenigbaar is met of noodzakelijk worden geacht voor de bescherming van de zone, zoals de installatie van brandbeschermende voorzieningen, de aanleg van brandgangen, werkzaamheden in verband met bosbeheer, de aanleg van wandel- en fietspaden, alsmede milieuvriendelijke maatregelen voor wateropslag in de beddingen van bergstromen.
37 That view is disputed, however, by some members of the referring court, who consider that the contested decree constitutes a management plan that is closely connected with and necessary for the protection of the site in question inasmuch as the classification of the site of the Mount Hymettus area in Zone A means absolute protection, not permitting any land use with the exception of installations that are compatible with or deemed necessary for the purposes of protecting the area, such as fire protection works, fire hydrants, forestry management works, the creation of trails and cycling paths and minor works to shore up stream beds.

34 De verwijzende rechterlijke instantie is van oordeel dat indien het Hof die vraag ontkennend mocht beantwoorden, in de derde plaats de vraag rijst of de vaststelling van het litigieuze besluit hoe dan ook had moeten worden onderworpen aan een milieubeoordeling krachtens artikel 3, lid 2, onder b), van richtlijn 2001/42, aangezien zone A, zoals die door datzelfde besluit is afgebakend, vrijwel het gehele gebied van het bergmassief van Imittos omvat, zoals dit wordt beschermd als GCB en SBZ.
34 The referring court considers that if the Court of Justice were to answer that question in the negative, then the question would arise, thirdly, whether the adoption of the contested decree was in any event subject to an environmental assessment under Article 3(2)(b) of Directive 2001/42, since Zone A, as defined by that decree, encompasses almost all of the site of the Mount Hymettus area as protected as a SCI and SPA.

40 Die opvatting wordt niet gedeeld door een minderheid van de leden van voornoemde rechterlijke instantie, die van oordeel is dat wanneer wordt getracht te komen tot een reglementering van de vormen van grondgebruik of de activiteiten die zijn toegestaan op een uitgestrekt gebied dat als een geheel wordt aangemerkt, zoals het gebied van het bergmassief van Imittos, de gegevens op uniforme wijze moeten worden beoordeeld en de milieubeoordeling niet fragmentarisch mag zijn.
40 That view is not shared by a minority of the members of that court, who are of the opinion that where it is intended to regulate land uses or permitted activities over a large area that is considered to form a whole, such as the site of the Mount Hymettus area, the data must be assessed in a unitary manner and the environmental assessment cannot be fragmentary.
