5 – According to Incoterms 2000 drawn up by the International Chamber of Commerce in Paris, ‘Ex works’ means that the seller fulfils his obligation to deliver when he has made the goods available at his premises (i.e. works, factory, warehouse etc.) or other named place to the buyer, without the goods being cleared for export and loaded onto a vehicle provided by the buyer.

22 In het kader van het onderzoek van een overeenkomst moet de nationale rechter bij de bepaling van de plaats van levering in de zin van artikel 5, punt 1, sub b, eerste streepje, van de verordening alle relevante voorwaarden en clausules van deze overeenkomst in de beschouwing betrekken, desgevallend met inbegrip van de voorwaarden en clausules die algemeen erkend zijn en door de internationale handel zijn ontwikkeld, zoals de Incoterms, indien zij van dien aard zijn dat deze plaats op basis daarvan duidelijk kan worden bepaald.
22 Thus, in order to determine, in the course of examining a contract, the place of delivery for the purposes of the first indent of Article 5(1)(b) of the Regulation, the referring court must take into account all the relevant terms and clauses in that contract, including, as the case may be, the terms and clauses generally recognised and applied in international commercial usage, such as the Incoterms, in so far as they enable that place to be clearly identified.
