38 As the Italian legislation stands, the Massafra installation for the incinceration of CMW and biomass is considered to be an installation for the recovery of non-hazardous waste, with a capacity exceeding 100 tonnes per day, subject to the simplified procedures under the provisions of Legislative Decree No 22/1997, intended to transpose Article 11 of Directive 75/442.

In 2005 is door de nv Snam Rete Gas een plan voorgesteld voor de aanleg van een gaspijpleiding met de naam „Rete Adriatica” („Adriatisch net”) die een totale lengte zou hebben van 687 km (buis met een diameter van 1200 mm op 5 m diepte, erfdienstbaarheid van 40 m) en die volgens het voorstel in één lijn zou lopen van het zuiden (Massafra, provincie Taranto) tot Noord-Italië (Minerbio, provincie Bologna).

24 Aangezien de Commissie geen genoegen kon nemen met de aldus door de Italiaanse regering verstrekte antwoorden, heeft zij de precontentieuze procedure ingeleid met een aanvankelijke aanmaningsbrief van 18 oktober 2002, aangevuld met een brief van 11 juli 2003, in welke brieven melding wordt gemaakt van tekortkomingen die verband houden met de behandeling van de industriële installatie te Massafra en met de nationale wetgeving zelf.
