(9) - This does not detract from its value as a precedent for the present case: as the Court held in Apple and Pear Development Council (cited above, at point 10) and Naturally Yours Cosmetics (cited above, at point 10), the case-law concerning the Second VAT Directive may, in view of the Community aims which underlie both it and the Sixth Directive, provide guidance for the interpretation of the latter directive.

2 Die vraag is gerezen in een geding tussen Naturally Yours Cosmetics Limited ( verzoekster in het hoofdgeding, hierna : verzoekster ) en de Commissioners of Customs and Excise ( verweerders in het hoofdgeding, hierna : verweerders ) ter zake van een door de Commissioners over het jaar 1984 opgelegde BTW-aanslag .

Aangezien het Bundesfinanzhof van mening was dat het Hof zich over de vraag van de relevantie van de bijkomende kosten voor de maatstaf van heffing, zoals deze in het onderhavige geval van met ruil vergelijkbare handelingen aan de orde is, in de zaken Naturally Yours Cosmetics en Empire Stores niet duidelijk heeft uitgesproken, heeft het de procedure geschorst en bij beschikking van 5 augustus 1999 het Hof de volgende prejudiciële vraag voorgelegd:

Moreover, the Council Directive 2013/59/Euratom on basic safety standards 11 defines harmonised clearance criteria and general levels for release of material from regulatory control, while the scope of the basic safety standards extends to cover human activities which involve the presence of natural radiation sources, including the processing of naturally occuring radioactive materials (NORM).

14 Volgens dezelfde rechtspraak moet die tegenprestatie bovendien in geld kunnen worden uitgedrukt (arresten Coöperatieve Aardappelenbewaarplaats, r.o. 13; Naturally Yours Cosmetics, r.o. 16, en Argos Distributors, r.o. 17, reeds aangehaald).
14 Furthermore, according to the same case-law, that consideration must be capable of being expressed in money (judgments in Coöperatieve Aardappelenbewaarplaats, paragraph 13; Naturally Yours Cosmetics, paragraph 16, and Argos Distributors, paragraph 17).

27 Volgens vaste rechtspraak is die tegenprestatie een "subjectieve" waarde, namelijk de in een concreet geval werkelijk ontvangen tegenprestatie, en niet een volgens objectieve maatstaven geschatte waarde (arresten van 23 november 1988, zaak 230/87, Naturally Yours Cosmetics, Jurispr. 1988, blz. 6365, r.o. 16, en 27 maart 1990, zaak C-126/88, Boots Company, Jurispr. 1990, blz. I-1235, r.o. 19).

That consideration is thus the subjective value, that is to say, the value actually received, in each specific case, and not a value estimated according to objective criteria (see Case 154/80 Staatssecretaris Van Financiën v Cooperatieve Aardappelenbewaarplats [1981] ECR 445; Case 230/87 Naturally Yours Cosmetics [1988] ECR 6365; Case C-126/88 Boots v Commissioners of Customs and Excise [1990] ECR I-1235; and Case C-38/93 Glawe [1994] ECR I-1679).
