Bijgevolg blijkt niet van feiten of omstandigheden die de geldigheid kunnen aantasten van enerzijds de richtlijnen 2008/58 en 2009/2 en anderzijds verordening nr. 790/2009, voor zover deze richtlijnen en deze verordening stoffen als bepaalde nikkelcarbonaten, nikkelhydroxiden en andere groepen nikkelverbindingen hebben ingedeeld als bij de mens kanker verwekkende stoffen van categorie 1, mutagene stoffen van categorie 3 en voor de voortplanting giftige stoffen van categorie 2.
Consequently, there is no factor of such a kind as to affect the validity, first, of Directives 2008/58 and 2009/2 and, second, of Regulation No 790/2009, in so far as those directives and that regulation classified as carcinogenic to man in category 1, mutagenic in category 3 and reprotoxic in category 2 substances such as certain nickel carbonates, nickel hydroxides and other grouped nickel substances.

To this end, what is the Commission’s assessment of whether the proposed classification of nickel hydroxide (which is insoluble in water) in the 31st ATP is justified under the criteria of the Dangerous Substances Directive, given that it is also based on derogation statements given by individual producers of nickel carbonate and, ultimately, the intrinsic properties of nickel sulphate (soluble)?
