236 Next, as regards the pricing information set out in table 33 in the Annex to the contested decision, the applicants maintain that, during the period between 1995 and 1997, the prices of Antra 20 mg capsules (omeprazole), Agopton 30 mg capsules (lansoprazole) and Rifun 40 mg tablets (pantoprazole) were the same, which indicates that AZ was not able to maintain higher prices than its competitors.

274 Wat voorts het argument van verzoeksters betreft dat lansoprazol en pantoprazol respectievelijk in 1993 en 1994 op de Duitse markt zijn gelanceerd, dient te worden opgemerkt dat de sterke bescherming die intellectuele-eigendomsrechten verlenen niet noodzakelijkerwijs elke mededinging op de markt hoeft uit te sluiten om een relevante factor te zijn.
274 In addition, as regards the applicants’ argument that lansoprazole and pantoprazole entered the German market in 1993 and 1994 respectively, the Court observes that, to be a relevant factor, the existence of solid protection by means of intellectual property rights does not necessarily have to be such as to exclude all competition on the market.

277 The applicants dispute however the relevance of AZ’s first-mover status, in the light, in particular, of the fact that pantoprazole had acquired a 20.66% market share in 1995 in Germany after only two years of presence on the market.

In casu wijst deze gebeurtenis, zoals verzoeksters tijdens de administratieve procedure hebben gesteld (zie punten 427 en 428 van de bestreden beschikking), erop dat in Duitsland slechts prijsconcurrentie op intermoleculair niveau bestond voor zover de betrokken producten een zeer gelijkaardig therapeutisch profiel hadden, wat het geval bleek te zijn voor omeprazol en pantoprazol, twee PPR’s.
In the present case, and as the applicants stated during the administrative procedure (see recitals 427 and 428 of the contested decision), that event tends to show that price competition at the inter-molecular level existed in Germany only in so far as the relevant products had a very similar therapeutic profile, which appeared to be the case with omeprazole and pantoprazole, those products both being PPIs.

202 As regards, first of all, the entry on the German market of pantoprazole in 1994, the Commission found, in recital 422 of the contested decision, that it was accompanied by a reduction in the price of Losec of 16%, but that it did not significantly affect the slowly falling trend in the price level of H2 blockers.
