In concreto heeft deze grief betrekking op punt 31 van het programma van eisen, waar de aanbieder in kennis wordt gesteld van de „eis” dat de Provincie Noord-Holland voor het koffie‐ en theegebruik van het Max Havelaar- en EKO-keurmerk „gebruikmaakt”.
This plea relates specifically to paragraph 31 of the Requirements Profile in which suppliers were informed by way of a ‘requirement’ that the Province of Noord‐Holland ‘uses’ the ‘Max Havelaar’ and ‘EKO’ labels in relation to the consumption of coffee and tea.

Zoals de Nederlandse regering terecht heeft opgemerkt, heeft de Provincie Noord-Holland in punt 35 van het programma van eisen alleen maar als criterium aangeduid dat de te leveren ingrediënten voorzien zouden zijn van een keurmerk waaruit bleek dat het ging om fairtradeproducten.
