It merely took the view that, first, the use of such a method should be permitted only if it is fully consistent with the objective of prevention and control of pollution arising from certain activities, pursued by Directive 96/61, and that, secondly, the use of that method must not have the effect of excluding from the system established by that directive installations set up under that method in relation to their total number of places (Association nationale pour la protection des eaux et rivières and OABA, paragraph 40).
