Hoewel de Europese Commissie de beslissing van het Verenigd Koninkrijk om zich terug te trekken uit de Unie betreurt, zoals op 24 juni 2016 door Jean-Claude Juncker, voorzitter van de Europese Commissie, samen met Martin Schulz, voorzitter van het Europees Parlement, Donald Tusk, voorzitter van de Europese Raad, en Mark Rutte, toenmalig voorzitter van de Raad van de EU, is kenbaar gemaakt (2), bieden de Verdragen geen grondslag voor de vaststelling van een rechtshandeling die betrekking heeft op het besluitvormingsproces binnen een lidstaat in verband met de kennisgeving dat die lidstaat het voornemen heeft om zich krachtens artikel 50 VEU uit de Unie terug te trekken.
