27 Verder heeft het Hof verklaard dat de richtlijn zich verzet tegen een nationale regeling waarbij de executierechter bij hypothecaire executie niet ambtshalve of op verzoek van de consument kan toetsen of een beding dat is opgenomen in de overeenkomst waaruit de gevorderde schuld voortvloeit en dat ten grondslag ligt aan de executoriale titel, oneerlijk is, en evenmin voorlopige maatregelen, waaronder met name de schorsing van de executie, kan opleggen wanneer deze maatregelen noodzakelijk zijn ter verzekering van de volle werking van de einduitspraak van de rechter die de desbetreffende declaratoire procedure behandelt (beschikking van 14 november 2013, Banco Popular Español en Banco de Valencia, C‐537/12 en C‐116/13, EU:C:2013:759, punt 60).
27 Similarly, the Court has held that that directive precludes national legislation which does not allow the court responsible for enforcement, in mortgage enforcement proceedings, either to assess of its own motion or at the consumer’s request, the unfairness of a term contained in the contract which gives rise to the debt claimed and which constitutes the basis of the right to enforcement, or to grant interim relief, including, in particular, staying the enforcement proceedings, where the grant of such relief is necessary to ensure the full effectiveness of the final decision of the court adjudicating on the substance of the case (order of 14 November 2013, Banco Popular Español and Banco de Valencia, C‐537/12 and C‐116/13, EU:C:2013:759, paragraph 60).EurLex-2 EurLex-2
