115 De Commissie betwist ook dat het feit dat zij in de brief van 25 juli 2000 niet heeft gereageerd op de verklaring van Masdar in haar brief van 15 juni 2000 dat zij „de toezegging [had] gekregen dat de Europese Commissie, indien [zij] met de projecten door[ging], ervoor zou zorgen dat [zij] voor [haar] diensten [zou] worden betaald”, kan worden beschouwd als de uitdrukkelijke verzekering of een stilzwijgende erkenning dat Masdar contractuele betrekkingen met de Commissie had aangeknoopt of dat de Commissie zich had verplicht ervoor te zorgen dat verzoekster zou worden beloond voor alle werkzaamheden die zij krachtens haar contract met Helmico had uitgevoerd (arrest Gerecht van 27 maart 1990, Chomel/Commissie, T‐123/89, Jurispr. blz. II‐131, punt 27).
115 The Commission also denies that its absence of reaction in the letter of 25 July 2000 to the assertion made by Masdar in its letter of 15 June 2000 that it had been ‘given assurances that if [it] continued with the projects the European Commission would ensure that [it would be] paid for [its] services’ may be taken as an express guarantee or a tacit agreement that Masdar had entered into contractual relations with the Commission, or that the Commission had undertaken to ensure that the applicant would be paid for all the work which it had performed under its contract with Helmico (Case T-123/89 Chomel v Commission [1990] ECR II-131, paragraph 27).EurLex-2 EurLex-2
