Ofschoon al dan niet recycleerbare afvalstoffen zijn te beschouwen als produkten waarvan het verkeer overeenkomstig artikel 30 van het Verdrag in beginsel niet mag worden beperkt, kan de richtlijn niettemin niet worden geacht uitvoering te geven aan het beginsel van vrij verkeer van die produkten. Zij strekt integendeel tot uitvoering van het beginsel, dat milieuaantastingen bij voorkeur aan de bron moeten worden bestreden, welk beginsel voor het optreden van de Gemeenschap op milieugebied is neergelegd in artikel 130 R, lid 2, van het Verdrag.
Whilst it is true that waste, whether recyclable or not, is to be regarded as goods the movement of which, in accordance with Article 30 of the Treaty, must in principle not be prevented, the directive in question cannot, for all that, be regarded as implementing the free movement of such products, since, on the contrary, it implements the principle that environmental damage should as a priority be rectified at source, a principle laid down by Article 130r(2) of the Treaty as a basis for action by the Community relating to the environment.EurLex-2 EurLex-2
