34 Voorts wenst de verwijzende rechter in wezen te vernemen, of, wanneer de lidstaat van waaruit de meststoffen afkomstig zijn in een vermindering van heffing voorziet bij uitvoer naar andere lidstaten, een heffing zoals de in het hoofdgeding aan de orde zijnde invoerheffing mogelijkerwijs niet moet worden aangemerkt als een heffing van gelijke werking als een douanerecht, zoals VLM betoogt, vanwege de noodzaak om het Vlaamse mestbestand in de hand te houden en de interne productie te beschermen tegen concurrentieverstorende en voor Vlaanderen extra milieubelastende maatregelen van buitenaf.
34 Furthermore, the referring court asks, in essence, whether, in the event that the Member State of origin of the fertiliser applies a tax reduction where the fertiliser is exported to other Member States, a levy such as the import levy at issue in the main proceedings could avoid classification as a charge having equivalent effect to a customs duty, as the VLM argues, because of the need to control the stocks of manure in Flanders and to protect domestic production against external measures that distort competition and impose an additional environmental burden on Flanders.EurLex-2 EurLex-2
