Dit gerecht heeft het beginsel geïntroduceerd volgens hetwelk „een nationaal gerecht alleen kan beslissen de zaak op grond van het forum non conveniens aan te houden indien het ervan overtuigd is dat een ander, eveneens bevoegd gerecht, gelet op de belangen van alle partijen en een goede rechtsbedeling, objectief gezien een geschikter forum is om het geschil te beslechten”.(14) Anders dan de uitdrukking forum non conveniens zou kunnen doen vermoeden, gaat het bij de aangezochte rechter derhalve niet om een simpele vraag van praktische of persoonlijke „conveniëntie”, met name verband houdend met de werklast van het gerecht, maar veeleer om een kwestie van objectieve geschiktheid van het forum voor de berechting van het betrokken geschil.(15)
26. That court laid down the principle that ‘a stay will only be granted on the ground of forum non conveniens where the court is satisfied that there is some other available forum, having competent jurisdiction, which is the appropriate forum for the trial of the action, i.e. in which the case may be tried more suitably for the interests of all the parties and the ends of justice’. (14) Contrary to what might be inferred from the expression forum non conveniens, it is not, for the court seised, a simple question of practical or personal ‘convenience’, associated in particular with the burdening of the court, but rather a question concerning the objective appropriateness of the forum for trial of the dispute.
