58 Met het tweede onderdeel van het eerste middel van de hogere voorziening voert Safa Nicu Sepahan in de eerste plaats aan dat, hoewel het Gerecht in de punten 99, 102, 104, 145 en 147 van het bestreden arrest heeft erkend dat de vaststelling van de aan de orde zijnde beperkende maatregelen materiële schade heeft veroorzaakt in de context van de overeenkomst voor de renovatie van de elektriciteitscentrale te Derbendikhan (Irak), het echter, willekeurig en in strijd met artikel 340, tweede alinea, VWEU en artikel 41, lid 3, van het Handvest van de grondrechten van de Europese Unie (hierna: „Handvest”), heeft geweigerd de Raad te veroordelen tot herstel van de veroorzaakte schade.
