"Voor zodanige vordering geldt de termijn van artikel 91 van het Statuut niet" ( zo achtte het Hof in zijn arrest van 28 mei 1970, gevoegde zaken 19, 20, 25 en 30/69, Richez-Parise, Jurispr . 1970, blz . 325 een bij repliek ingestelde en op dienstfout van de administratie gebaseerde schadevordering ontvankelijk ); daarbij komt dat, aangezien het in casu een beroep in volle omvang betreft, "het Hof, ook indien zulks niet formeel is gevorderd, ... bevoegd is ... zo nodig ( de administratie ) ambtshalve te veroordelen tot betaling van een vergoeding voor de door haar dienstfout veroorzaakte schade" ( zie de arresten van 9 juli 1970, zaak 23/69, Fiehn, Jurispr . 1970, blz . 547 en 27 oktober 1987, gevoegde zaken 176 en 177/86, Houyoux, Jurispr . 1987, blz . 4333 ).
It "is not subject to the time-limits laid down in Article 91 of the Staff Regulations" ( in the judgment in Joined Cases 19, 20, 25 and 30/69 Richez-Parise v Commission (( 1970 )) ECR 325, for example, the Court upheld the admissibility of a claim for damages - occasioned by a wrongful act or omission of the administration - which was submitted at the reply stage ); moreover, since this is a matter in which the Court has unlimited jurisdiction, "even in the absence of proper conclusions, it has the power ... if necessary, of its own motion to order (( the administration )) to pay compensation for damage occasioned by the (( administration' s )) wrongful act or omission" ( see judgments in Case 23/69 Fiehn v Commission (( 1970 )) ECR 547 and Joined Cases 176 and 177/86 Houyoux v Commission (( 1987 )) ECR 4333 ).EurLex-2 EurLex-2
