Bijgevolg behoort alleen het Unierecht tot de juridische sfeer waarin het beginsel iura novit curia van toepassing is, terwijl voor het nationale recht de voor de uiteenzetting van de feiten kenmerkende stelplicht en bewijslast gelden en de inhoud ervan in voorkomend geval uit bewijsstukken moet blijken [zie in die zin arrest van 20 maart 2013, El Corte Inglés/BHIM – Chez Gerard (CLUB GOURMET), T‐571/11, EU:T:2013:145, punt 35 en aldaar aangehaalde rechtspraak].
