47 Evenmin kan verzoeksters stelling worden aanvaard dat de kamer van beroep blijk heeft gegeven van een onjuiste rechtsopvatting door de omstandigheden waarin een nieuwe naam voor een hondenras wordt vastgesteld enerzijds en een plantenras wordt aangeduid anderzijds, als vergelijkbaar te bestempelen, waarbij verzoekster met name aanvoert dat het systeem van erkenning van hondenrassen waaraan fokkers van honden die voortkomen uit het gefokte ras „continental bulldog” deelnemen of overwegen deel te nemen, in feite onder de handelingen van particuliere verenigingen valt die geen enkel bindend rechtsgevolg sorteren, daar elk door de nationale of Europese wetgever vastgesteld systeem van bescherming of erkenning ontbreekt.
47 The applicant’s assertion that the Board of Appeal erred in law in comparing the circumstances of the determination of a new name for a breed of dog on the one hand and the designation of a plant variety on the other cannot be upheld either; the applicant alleges inter alia that the system of recognition of dog breeds, in which breeders of ‘continental bulldogs’ participate or envisage participating, falls within the scope of acts of private associations without binding legal effect, in the absence of any system of protection or recognition laid down by the national or EU legislature.
