160 Voor zover verzoekster zich met betrekking tot de gestelde schending van het rechtszekerheids- en het vertrouwensbeginsel beroept op de rechtspraak volgens welke het fundamentele vereiste van rechtszekerheid er zich tegen verzet dat wanneer voorschriften met betrekking tot een verjaringstermijn ontbreken, de Commissie eindeloos kan wachten met de uitoefening van haar bevoegdheden (arrest Gerecht van 6 oktober 2005, Sumitomo Chemical en Sumika Fine Chemicals/Commissie, T‐22/02 en T‐23/02, Jurispr. blz. II‐4065, punten 87‐89), volstaat de opmerking dat de in die rechtspraak bedoelde hypothese in casu niet relevant is, daar voor de sanctiebevoegdheid die de Commissie jegens verzoekster heeft uitgeoefend een verjaringstermijn geldt die is bepaald in artikel 25, lid 1, sub b, van verordening nr. 1/2003 en artikel 1, lid 1, sub b, van verordening nr. 2988/74.
160 With regard to the alleged breach of the principles of legal certainty and the protection of legitimate expectations, in so far as the applicant relies on the case‐law which states that, in the absence of any provision laying down a limitation period, the fundamental requirement of legal certainty has the effect of preventing the Commission from indefinitely delaying the exercise of its powers (Joined Cases T‐22/02 and T‐23/02 Sumitomo Chemical and Sumika Fine Chemicals v Commission [2005] ECR II‐4065, paragraphs 87 to 89), it is sufficient to observe that the situation referred to by that case-law is irrelevant in the present case because the Commission’s power to impose penalties, which was exercised in relation to the applicant, is subject to a limitation period referred to in Article 25(1)(b) of Regulation No 1/2003 and in Article 1(1)(b) of Regulation No 2988/74.EurLex-2 EurLex-2
