1 ) Worden, wanneer een burgerlijke vennootschap van auteurs, componisten en muziekuitgevers, SACEM genaamd, die op een belangrijk deel van de gemeenschappelijke markt een machtspositie inneemt en overeenkomsten van wederzijdse vertegenwoordiging ( wederkerigheidscontracten ) heeft gesloten met auteursrechtenbureaus in andere EEG-landen, een tarief voor gecombineerde royalty' s vaststelt op basis van 8,25 % van de bruto-omzet van een discotheek, inclusief belastingen aan de medecontractanten rechtstreeks of zijdelings onbillijke contractuele voorwaarden opgelegd, in de zin van artikel 86 EEG-Verdrag, indien dit tarief duidelijk hoger ligt dan dat wat door identieke auteursverenigingen in andere Lid-Staten van de Europese Economische Gemeenschap wordt toegepast?
