(12) Therefore, the objective of this Regulation is to adapt the legal framework to provide a common approach to the provision of online content services by establishing a strictly interpretable legal fiction in order to permit cross-border portability of online content services in the case of consumers that have legally acquired content and are temporarily present in a Member State other than that of their Member State of residence, and, with regard to the audiovisual sector, without undermining or abolishing the territorial principle as that would lead to a disproportionate loss to the detriment of the right holders and to a significant distortion of the market for audiovisual content.
