It therefore appears to fall within the remit of the Court of Auditors to "examine whether all revenue has been received and all expenditure incurred in a lawful and regular manner and whether the financial management has been sound" (Art. 248 (2) EC).

Artikel 1 van de bijlage bij het Statuut van het Hof van Justitie geldt derhalve niet voor het beroep dat een lid van de Rekenkamer instelt op grond van artikel 236 EG.
Consequently, Article 1 of the Annex to the Statute of the Court of Justice does not apply to an action brought by a member of the Court of Auditors on the basis of Article 236 EC.

In deze context verleent artikel 188 C, lid 3, van het EG-Verdrag de Rekenkamer met name de bevoegdheid controles uit te voeren in de lidstaten ter plaatse.
