35 Voorzover DKV in hogere voorziening aanvoert dat artikel 12, sub b, van verordening nr. 40/94 tevens de uitlegging van artikel 7, lid 1, sub b, matigt, zij opgemerkt dat dit argument een nieuw middel is dat voor het eerst in hogere voorziening voor het Hof wordt aangevoerd, en derhalve niet-ontvankelijk is (zie met name beschikking van 13 september 2001, Personeelscomité van de ECB e.a. /ECB, C-467/00 P, Jurispr. blz.
