In de programmeringsperiode 2014-2020 zijn er instrumenten voorhanden om de doeltreffendheid van plattelandsontwikkelingsmaatregelen inzake waterbescherming te vergroten, maar die zijn nog niet ten volle benut 100 In Verordening ( EU ) nr. 1305 / 201367 is voorzien in een specifieke prioriteit voor waterbescherming in de plattelandsontwikkelingsprogramma ’ s en zijn ex-antevoorwaarden vastgelegd waaraan moet worden voldaan met betrekking tot de tenuitvoerlegging van de kaderrichtlijn water en de milieuwetgeving die van toepassing is op de landbouw.

Deze plannen zijn mogelijk onverenigbaar met de bestaande verplichtingen uit hoofde van de EU-milieuwetgeving.
The Commission is also aware of other intentions of the Netherlands Government with regard to nature conservation, such as those concerning a limited implementation of ‘agri-environmental’ measures and the re-consideration of earlier decisions with regard to the flooding of the Hedwigepolder in Zeeuws-Vlaanderen or the partial opening of the floodgate in the Haringvliet (‘Kierbesluit’), which could possibly be incompatible with regard to existing obligations under EU environmental legislation.
