4064/89. Artikel 18, lid 4, van die verordening regelt uitdrukkelijk het recht van zulke vertegenwoordigende organen om te worden gehoord wanneer de Commissie de economische balans opmaakt van de betrokken concentratie, waarbij zij in voorkomend geval overwegingen van sociale aard kan laten meewegen; dat recht te worden gehoord, aldus het Gerecht, "geeft (...) blijk van de wil de inaanmerkingneming van de collectieve belangen van die werknemers tijdens de administratieve procedure te verzekeren".(
Article 18(4) of that Regulation expressly refers to the right of such representatives to be heard when the Commission draws up the economic balance for the concentration in question, which may, in some circumstances, entail considerations of a social nature; that right to be heard, the Court of First Instance stated, `manifests an intention to ensure that the collective interests of those employees are taken into consideration in the administrative procedure'.EurLex-2 EurLex-2
