47 Bovendien volgt, in tegenstelling tot hetgeen de verwijzende rechter oppert, zowel uit de beoordelingsvrijheid waarover de lidstaten beschikken bij de erkenning van privaatrechtelijke inrichtingen met het oog op de toepassing van artikel 13, A, lid 1, sub b, van de Zesde richtlijn, als uit de bepalingen van lid 2, sub a, van dit artikel, welke bepaling deze staten niet verplicht de daarin genoemde voorwaarden te stellen, maar hun toestaat dergelijke voorwaarden van geval tot geval op te leggen, dat de lidstaten voor de vrijstelling van medische analyses als medische verzorging in beginsel andere voorwaarden kunnen stellen dan de voorwaarden voor vrijstelling van nauw met dergelijke verzorging samenhangende handelingen.
47 Moreover, and contrary to the suggestion made by the national court, it follows from both the discretion conferred on the Member States for the recognition of establishments governed by private law for the purposes of application of Article 13A(1)(b) of the Sixth Directive and from Article 13A(2)(a) thereof, which does not require the Member States to impose the conditions laid down therein but rather allows them to impose such conditions on a case-by-case basis, that those same States may, in principle, make the exemption of medical tests as medical care subject to conditions other than those used for the exemption of activities closely related to such care.EurLex-2 EurLex-2
