21 Uit het voorgaande volgt, dat het Groothertogdom Luxemburg, door de verkoop van roerende lichamelijke goederen in het kader van een reclamecampagne, en geleverde diensten in het kader van diverse "public relations"-manifestaties, zoals persconferenties, seminars, cocktailparty's, recreatieve bijeenkomsten en dergelijke, uit te sluiten van het begrip "diensten op het gebied van de reclame" in artikel 9, lid 2, sub e, van de Zesde richtlijn, ook wanneer deze handelingen het doorgeven van een reclameboodschap inhouden of hiermee onlosmakelijk zijn verbonden, de krachtens die richtlijn en het EEG-Verdrag op hem rustende verplichtingen niet is nagekomen.
21 It follows that, by excluding the sale of movable tangible property in the context of an advertising campaign and services provided in connection with a variety of public-relations events, such as press conferences, seminars, cocktail parties and recreational functions, from the concept of "advertising services" under Article 9(2)(e) of the Sixth Directive, even where those transactions either involve conveying an advertising message or are inextricably linked to the conveying of such a message, the Grand Duchy of Luxembourg has failed to fulfil its obligations under that directive and under the EEC Treaty.EurLex-2 EurLex-2
