Rekwirante stelt dat het arrest van het Gerecht artikel 63 van verordening nr. 40/94 schendt, alsook de algemene beginselen van het communautaire bestuurs‐ en procesrecht, voor zover het Gerecht hierin, in strijd met de litigieuze beslissing van de kamer van beroep, heeft geconcludeerd dat de conflicterende merken, OBELIX et MOBILIX, niet overeenstemden, waarmee het aldus ten nadele van rekwirante uitspraak heeft gedaan over een vraag die niet volgens de regels was opgeworpen en de hem bij de toetsing van beslissingen van de kamers van beroep van het BHIM in een geval als het onderhavige verleende bevoegdheid heeft overschreden.
The appellant claims that the judgment of the Court of First Instance infringed Article 63 of Regulation No 40/94 as well as the general principles of Community administrative and procedural law in that it found, contrary to the contested decision of the Board of Appeal, that the conflicting marks, ‘OBELIX’ and ‘MOBILIX’, were not similar, thus ruling to the detriment of the appellant on a question which had not been raised in a formally correct manner, thus exceeding its jurisdiction in the review of decisions of the Boards of Appeal of OHIM in a case such as this one.EurLex-2 EurLex-2
