85 De Commissie heeft namelijk niet enkel overwogen dat de progressieve tariefstructuur van de betrokken belasting afwijkt van een „normaal” stelsel – dat in casu onvolledig of hypothetisch is bepaald – maar heeft tevens in wezen gemotiveerd dat er een selectief voordeel is ten gunste van ondernemingen met een lage omzet, een en ander op basis van het arrest van 15 november 2011, Commissie en Spanje/Government of Gibraltar en Verenigd Koninkrijk (C‐106/09 P en C‐107/09 P, EU:C:2011:732), dat betrekking had op een belastingstelsel dat op zich discriminerend was in het licht van de doelstelling dat het na zou streven, anders gezegd in het licht van de aard ervan.
