96 In het licht van het voorgaande en van punt 76 van dit arrest, wenst de verwijzende rechter in wezen te vernemen of artikel 10 bis, leden 1 en 4, van richtlijn 2003/87 en artikel 10, lid 3, van besluit 2011/278 in die zin moeten worden uitgelegd dat zij zich er niet tegen verzetten dat geen extra kosteloze emissierechten worden toegewezen voor emissies verbonden met de productie van meetbare warmte door verbranding van restgassen die zijn geproduceerd door een installatie met een benchmark voor vloeibaar ruwijzer, voor zover de op basis van de warmtebenchmark bepaalde hoeveelheid emissierechten lager is dan de mediane waarde van de historische emissie verbonden met de productie van deze warmte.
96 In the light of the above, and paragraph 76 above, the referring court asks, in essence, whether Article 10a(1) and (4) of Directive 2003/87 and Article 10(3) of Decision 2011/278 must be interpreted as permitting the non-allocation of free allowances for emission related to the production of measurable heat by burning waste gases that were generated by a hot metal benchmark installation, when the amount of allowances determined based on the heat benchmark is lower than the median annual historical emissions related to the production of that heat.

In this regard, the Commission notes that the emissions covered by the process emissions sub-installation are already covered by the product benchmark sub-installation for hot metal on the basis of which one of the installations also receives an allocation and are thus double counted.

The applicant is of the view that the contested decision should be annulled in its entirety, since annulment limited exclusively to the benchmark for hot metal would automatically lead to application of a fall-back method for the allocation of free allowances pursuant to Article 10(2)(b) in conjunction with Article 3(c) of the contested decision.

SOORTGELIJK PRODUKT (6) Sommige gieterijen en verenigingen in de Gemeenschap (gebruikers van het betrokken produkt) voerden aan dat de belangrijkste producent van de Gemeenschap voor de produktie van gieterijruwijzer andere grondstoffen gebruikt dan hematietgietijzer; dat dit produkt niet voor dezelfde doeleinden kon worden gebruikt als het ingevoerde ruwijzer dat van hematietijzererts wordt vervaardigd en dat het gieterijruwijzer van deze producent en het gieterijruwijzer dat werd ingevoerd, derhalve geen soortgelijke produkten zijn in de zin van artikel 2, lid 12, van Beschikking nr. 2424/88/EGKS.
LIKE PRODUCT (6) It has been stated by some foundries and associations in the Community (users of the product concerned) that the major Community producer uses inputs other than hematite iron for the production of its foundry pig-iron, that this product could not serve the same purposes as the imported pig-iron produced from hematite iron ore, and that therefore this producer's foundry pig-iron and the imported foundry pig-iron are not like products within the meaning of Article 2 (12) of Decision No 2424/88/ECSC.

Application under Article 265 TFEU for a declaration that the Commission unlawfully refrained from taking a decision concerning the total annual quantity of emissions quotas that must be granted free of charge in response to a significant increase in capacity by a sub-installation of the applicant with a product benchmark for hot metal and, in the alternative, an application under Article 263 TFEU for annulment of the decision allegedly adopted by the Commission on 19 July 2019 concerning the giving of notice to the applicant on 1 July 2019.

The applicants express the view that the decision must be annulled in its entirety on the ground that, in the event of a declaration of invalidity confined exclusively to the benchmarks for sintered ore and hot metal, a fallback method would, pursuant to the rule in Article 10(2)(b) of the contested decision, in conjunction with Article 3(c) thereof, automatically become applicable for the allocation of free allowances.

The determination of the product benchmark for hot metal, the applicants submit, also breaches Article 10a of Directive 2003/87, as the Commission did not take into account the full carbon content of the residual gases resulting from iron and steel production in respect of their use for electricity generation, but carried out reductions in the amount of approximately 25 %.
