Het reeds aangehaalde arrest Casati erkent weliswaar dat de strafwetgeving en de regels inzake de strafvordering tot de bevoegdheid van de lidstaten behoren, maar preciseert vervolgens dat deze voorschriften niet mogen worden misbruikt om de doelen van het Verdrag in het gedrang te brengen (punt 27); hieruit volgt, zoals in de arresten van 16 februari 1978, Schonenberg (88/77, Jurispr. blz. 473, punt 16), en 16 december 1981, Tymen (269/80, Jurispr. blz. 3079, punt 16), is vastgesteld, dat een strafrechtelijke veroordeling op grond van een met het gemeenschapsrecht strijdig bevonden nationale wettelijke bepaling eveneens daarmee onverenigbaar is.
It will be recalled that Casati, cited above, after acknowledging that the criminal law and the rules of criminal procedure were the responsibility of the Member States, stated that Member States could not abuse those provisions in order to impose obstacles to the objectives of the Treaty (paragraph 27), with the effect that, as stated in Case 88/77 Schonenberg [1978] ECR 473, paragraph 16, and Case 269/80 Tymen [1981] ECR 3079, paragraph 16, a conviction imposed by virtue of a national law contrary to Community law is, in turn, incompatible with European law itself.EurLex-2 EurLex-2
