Vanuit dit oogpunt zij erop gewezen dat elektriciteit, ondanks de kenmerken van deze energievorm, voorwerp kan zijn en in de praktijk ook is van handelstransacties, waarbij partijen (zoals bijvoorbeeld de distributeur of de eindgebruiker) de elektriciteit als goed opvatten dat niet alleen volledig zijn zelfstandig bestaan behoudt ten opzichte van verschillende activiteiten die na de opwekking zijn vereist om transport, distributie en verbruik mogelijk te maken, maar zich ook tot die activiteiten verhoudt als hoofdzaak tot bijzaak.
In that connection I must observe that, notwithstanding the special characteristics of electricity, that form of energy may be, and is in practice, the subject of commercial transactions in which the contracting parties (for example, the distributor and the final consumer) regard it not only as something which remains entirely independent from the various activities needed, after its production, in order to transmit, distribute and consume it, but also as something which is more important than those activities.EurLex-2 EurLex-2
