Richtlijn 2001/29/EG van het Europees Parlement en de Raad van 22 mei 2001 betreffende de harmonisatie van bepaalde aspecten van het auteursrecht en de naburige rechten in de informatiemaatschappij, in het bijzonder artikel 5, leden 2, sub b, en 5 ervan, moet aldus moeten worden uitgelegd dat de eindgebruiker die voor privégebruik een reproductie vervaardigt van een beschermd werk, in beginsel moet worden aangemerkt als de schuldenaar van de in voornoemd lid 2, sub b, bedoelde billijke compensatie.
