Poľské orgány oznámili 28. januára 2010 svoj zámer poskytnúť regionálnu pomoc na základe usmernení pre národnú regionálnu pomoc (ďalej len „UNRP“) (1) spoločnosti Fiat Powertrain Technologies Poland Sp. z o.o. (ďalej len „FPT Poľsko“) na jej investičný projekt v Bielsko-Bialej v regióne Sliezsko (województwo śląskie) v Poľsku. Ide o podporovanú oblasť v zmysle článku 107 ods. 3 písm. a) Zmluvy o fungovaní Európskej únie (ďalej len „ZFEÚ“) so štandardným stropom regionálnej pomoci pre veľké podniky vo výške 40 % ekvivalentu hrubého grantu.
On 28 January 2010, the Polish authorities notified their intention to grant regional aid under the Guidelines on national regional aid (hereinafter ‘RAG’) (1) to Fiat Powertrain Technologies Poland Sp. z o.o. (hereinafter ‘FPT Poland’) for its investment project in Bielsko-Biała in the Silesia region (województwo śląskie) of Poland, which is an assisted area in virtue of Article 107(3)(a) of the Treaty on the Functioning of the European Union (hereinafter ‘TFEU’) with a standard regional aid ceiling for large enterprises of 40 per cent Gross Grant Equivalent.

Na základe uvedených skutočností by podľa štúdie Ernst&Young (pozri tabuľku 26) veritelia dostali celkovo 122 mil. PLN v prípade predaja PZL Wrocław a ďalšieho majetku PZL Hydral, zatiaľ čo v prípade konkurzu vedúceho k likvidácii PZL Hydral by veritelia dostali iba 66 mil. PLN a traja z nich (ministerstvo financií, regionálny úrad Dolné Sliezsko a štátny fond na rehabilitáciu postihnutých osôb) by nedostali nič.
