porušil pravidlá výkladu pre dohody tým, že prijal zjavne nesprávny a neprípustný výklad zmluvy o dielo;

Podľa tohto ustanovenia je každá zmluva o dielo, ktorá sa týka trvalých a dlhodobých potrieb zamestnávateľa, absolútne neplatná.
