Eftersom Hacene Akrich, som var gift med en brittisk medborgare, saknade uppehållsrätt i Förenade kungariket, hade han gått med på att utvisas till Irland, där han återförenades med sin maka, som nyligen hade bosatt sig där. Mr Akrich, who was married to a British national and did not have the right to remain in the United Kingdom, had in fact agreed to be deported to Ireland, where he joined his wife who had installed herself there shortly before, and intended to return to the United Kingdom with his wife by taking advantage of the right of residence conferred by Community law as the spouse of a citizen of the Union who had exercised her right to free movement.EurLex-2 EurLex-2
