Vidare har den hänskjutande domstolen i sitt beslut påpekat att tveksamheten rörande tolkningen av direktiv 93/13 grundar sig på att Spanien, i likhet med andra medlemsstater, med stöd av bemyndigandet i artikel 8 i direktivet har avstått från att i den nationella lagstiftningen införliva artikel 4.2, i vilken stadgas undantag från den materiella domstolsprövningen av avtalsvillkor.(
