8 Finanzgericht har först anfört att även om försäljningen av mjölk till eleverna inte kan anses som direktförsäljning, är villkoren i artikel 12 h i förordning nr 857/84 likväl uppfyllda, då det med hänsyn till syftet med artikel 12 inte gör någon skillnad om mjölken säljs direkt eller indirekt, det vill säga via vederlaget för vistelsen i elevhemmet.
8 The Finanzgericht explains, first, that even if the sale of milk to pupils was not considered to be direct sale, the requirements of Article 12(h) of Regulation No 857/84 are, nevertheless, fulfilled, inasmuch as it should make no difference, for the purposes of Article 12, whether the milk is sold directly or indirectly, that is say through incorporation in the boarding fees.

11 Den första frågan går således ut på att få reda på om artikel 12 h i förordning nr 857/84 skall tolkas på så sätt att leverans av mjölk från ett lantbruk till elever och internatselever i en skola mot indirekt betalning av mjölkpriset, som ingår i vederlaget för vistelsen i elevhemmet, skall anses som direktförsäljning i den mening som avses i denna bestämmelse eller som egenkonsumtion, när lantbruket, skolan och elevhemmet drivs av samma institution.
