När exporten gjordes till dotterbolag som bedrev fullständig försäljnings- och marknadsföringsverksamhet i gemenskapen, bedömdes det med tanke på förhållandet mellan exportören och importören såsom lämpligt att konstruera exportpriserna på grundval av de priser till vilka kullagren först såldes vidare till en oberoende köpare.
(19) Where exports were made to subsidiary companies which carried out a complete sales and marketing operation within the Community, it was considered appropriate, in view of the relationship between exporter and importer, to construct export prices on the basis of the prices at which the bearings were first resold to an independent buyer.

5. Nio japanska tillverkare av kullagren i fråga, som enligt egen åsikt var av underordnad betydelse och som inte reagerat på tillkännagivandet om att ett antidumpningsförfarande skulle inledas tog kontakt med kommissionen inom den tid som fastställs i artikel 3 i förordning (EEG) nr 744/84.
(5) Within the time limit laid down by Article 3 of Regulation (EEC) No 744/84, nine Japanese manufacturers of the ball bearings in question who, in their own estimation, were of minor importance and who had not reacted to the notice of initiation of the anti-dumping proceeding made themselves known to the Commission.

27 Mot bakgrund av det ovan anförda finner domstolen att förstainstansrättens ogiltigförklaring - i dess dom i det ovannämnda målet NTN Corporation och Koyo Seiko mot rådet, vilken har fastställts genom domstolens dom i det ovannämnda målet kommissionen mot NTN och Koyo Seiko - av artikel 1 i förordning nr 2849/92, till den del som det i denna förordning har fastställts en antidumpningstull för NTN och Koyo Seiko, inte inverkar på giltigheten av andra delar av denna förordning. Särskilt gäller detta den antidumpningstull som påförts de av Nachi Fujikoshi tillverkade kullagren, eftersom denna tull inte omfattades av föremålet för den tvist som gemenskapsdomstolen avgjorde.
27 That being so, the annulment of Article 1 of Regulation No 2849/92 by the Court of First Instance in its judgment in NTN Corporation and Koyo Seiko v Council, upheld by the Court of Justice in Commission v NTN and Koyo Seiko, in so far as that article imposed anti-dumping duties on NTN and Koyo Seiko, did not affect the validity of the other aspects of that regulation, in particular the anti-dumping duty applicable to ball bearings manufactured by Nachi Fujikoshi, since those aspects did not form part of the subject of the dispute on which the Community judicature was called to rule.
