1 By application lodged at the Court Registry on 23 April 1991, Mr Jean-Marc Bosman, a professional football player, applied under the second paragraph of Article 173 of the EEC Treaty for the annulment of a decision adopted by the Commission on 17 April 1991, as set out in the Commission' s press release IP()1)316 of 18 April 1991, regarding an agreement between the Commission and the Union of European Football Associations (hereinafter referred to as "the UEFA") on nationality clauses applicable to national championships and the system of transfer fees applicable to the transfer of professional players from one club to another.

Jean-Marc Bosman, footballeur professionnel, a, en vertu de l' article 173, deuxième alinéa, du traité CEE, demandé l' annulation d' une décision adoptée le 17 avril 1991 par la Commission et relative à un accord entre celle-ci et l' Union européenne des associations de football ( ci-après "UEFA ") concernant les clauses de nationalité applicables aux championnats nationaux et le système des indemnités de transfert applicable aux transferts de joueurs professionnels d' un club à un autre, telle que cette décision résulte du communiqué de presse IP(91)316 de la Commission du 18 avril 1991 .

1 Con atto introduttivo depositato nella cancelleria della Corte il 23 aprile 1991, il sig. Jean-Marc Bosman, calciatore professionista, ha chiesto, ai sensi dell' art. 173, secondo comma, del Trattato CEE, l' annullamento di una decisione adottata il 17 aprile 1991 dalla Commissione e relativa ad un accordo tra quest' ultima e l' Unione europea delle associazioni calcistiche (in prosieguo: l' "UEFA") riguardante le condizioni di cittadinanza valide per i campionati nazionali e il sistema degli indennizzi in caso di trasferimento applicabile ai trasferimenti di giocatori professionisti da una società ad un' altra, come risulta dal comunicato stampa della Commissione 18 aprile 1991, IP(91)316.

Bosman, beroepsvoetballer, krachtens artikel 173, tweede alinea, EEG-Verdrag verzocht om nietigverklaring van een besluit van de Commissie van 17 april 1991 betreffende een overeenkomst tussen de Commissie en de Union européenne des Associations de Football (hierna: "UEFA") over de bij nationale kampioenschappen toepasselijke nationaliteitsclausules en het stelsel van transfersommen bij de overgang van beroepspelers naar een andere club, van welk besluit blijkt uit perscommuniqué IP(91)316 van de Commissie van 18 april 1991.
