In this connection, the “Decree” states that I.N.P.I., ex officio or upon request, according to the regulations that will be dictated, will declare the revocation of the trademark, even partially, in relation of products or services for which it has not been used in the country within 5 (five) years prior to the expiration request, unless if there were causes of overwhelming force.

Por su parte, el “Decreto” establece que el “I.N.P.I.”, de oficio o a pedido de parte, conforme a la reglamentación que se dicte, declarará la caducidad de la marca, inclusive parcialmente, en relación a los productos o servicios para los que no hubiere sido utilizada en el país dentro de los 5 (cinco) años previos a la solicitud de caducidad, salvo que mediaren causas de fuerza mayor.
