وأفادت الورقتان المشتركتان 1 و2 بأن ممارسة احتجاز ملتمسي اللجوء لفترة تتجاوز فترة إجراء التقييم المسبق البالغة 15 يوماً كحد أقصى استمرت في عامي 2009 و2010، وهو ما ينتهك التشريعات الوطنية انتهاكاً صارخاً رغم تدخل المدعي العام في نيسان/أبريل 2010 لوضع حد لذلك(48).

JS1 and JS2 indicated that the practice of keeping asylum seekers in detention beyond the period of pre-assessment procedure of maximum 15 days continued in 2009-2010, clearly in violation of national law and despite the intervention of the Prosecutor General in April 2010 to put an end to it.

En las comunicaciones conjuntas Nos. 1 y 2 se señalaba que en 2009 y 2010 continuaba la práctica de mantener detenidos a solicitantes de asilo durante un período superior al máximo de 15 días correspondiente al examen preliminar, en clara violación de la legislación nacional, y pese a la intervención del Fiscal General en abril de 2010 para poner fin a esta práctica .
