The offence of torture is committed by a public servant who, acting in that capacity or citing their position, either personally or through a third party deliberately inflicts injuries on an accused, indicted, convicted or any other person for the purposes of an investigation or legal procedure concerning criminal acts or offences in order to extract information or a confession from the person subjected to torture or from a third party, as an intimidatory measure or as punishment for an action or omission in which the person has been, or is suspected of having been, involved, or coerces the person into acting or refraining from acting in a particular manner.”

Comete el delito de tortura el servidor público que actuando con ese carácter o aduciendo su cargo, por sí o a través de un tercero, inflija intencionalmente a un inculpado, procesado, sentenciado o a cualquier persona lesiones con fines de investigación o procedimiento legal de hechos delictivos o infracciones, para obtener información o confesión del torturado o de un tercero, como medio intimidatorio, como castigo de una acción u omisión en que haya incurrido o se sospeche que incurrió, o las coaccione para que realicen o dejen de realizar una conducta determinada."

Государственное должностное лицо совершает преступление, если в силу своего положения или используя его, в ходе проведения расследования или следственных действий в отношении правонарушений или преступных деяний оно лично или через третье лицо умышленно причиняет лицу, которому предъявлено обвинение, которое находится под следствием или которому вынесен приговор, или любому другому лицу, телесные повреждения с целью получения информации или признания от лица, в отношении которого применяются пытки, или третьего лица, а также в целях запугивания, наказания за совершенное деяние или за непринятие мер для предотвращения совершенного или подозреваемого деяния, за соучастие в каком-либо определенном деянии или за попустительство при его совершении".
