وبناء على ذلك، خلصت المحكمة إلى أن المدعي لم يكن عضوا في الأمم المتحدة، ولم يكن بهذه الصفة دولة طرفا في النظام الأساسي لمحكمة العدل الدولية في تاريخ تقديم طلب الشروع في الإجراءات بشأن كل قضية من القضايا المعروضة على المحكمة في 29 نيسان/أبريل 1999.

The Court therefore concluded that the Applicant thus was not a Member of the United Nations, and in that capacity a State party to the Statute of the International Court of Justice, at the time of filing its Application to institute the proceedings in each of the cases before the Court on 29 April 1999.
